We also respect manufacturer's rights exclusive distribution or resale agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. Enforcement of such agreements is a matter between the manufacturer, distributor, and/or reseller. We cannot provide legal advice or share private information protected by law.
TRADEMARKS AND COPYRIGHTS

If we do not take action in response to a breach of these conditions, we still retain the right to use our rights and remedies in any future situation where you breach these conditions.
TERMINATION
We may, without prior notice, immediately terminate these Terms and Conditions or revoke any or all of your rights granted under them. Upon termination, you must cease all access to and use of the Site. We shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. 3. CONDITIONS RELATED TO SALE OF THE PRODUCT OR SERVICE (BETWEEN SELLERS AND CUSTOMERS)
Please read these conditions carefully before placing an order for any products with the Sellers (“We” or “Our” or “Us”, wherever applicable) on the Site. These conditions signify your agreement to be bound by these conditions. This section deals with conditions relating to the sale of products or services on the Site.
THE CONTRACT
When you place an order on our Site, you are making a legal offer to purchase the displayed product or service on our Site. Any confirmations or status updates you receive before your order is dispatched are only to validate your order details and do not imply order confirmation. The acceptance of your order is considered confirmed when the product is dispatched to you. If your order is dispatched in multiple packages, you may receive separate dispatch confirmations. PRICING, AVAILABILITY AND ORDER PROCESSING
All prices are listed in Bangladeshi Taka (BDT) and include VAT, as set by the seller. Items in your Shopping Cart will always reflect the most recent price displayed on the item's product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your basket and the time you purchase it.
We do not offer price matching for any items sold by any seller on our Site or other websites.
While we strive to provide the most accurate pricing information, on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. আপনি স্পষ্টভাবে Cartup, US Bangla Group এর একটি সহায়ক সংস্থা এবং এর সহযোগী প্রতিষ্ঠান, কর্মকর্তা এবং প্রতিনিধিদের, বিক্রেতা বা পরিষেবা প্রদানকারীদের কর্মকাণ্ড বা অক্রিয়তার কারণে সৃষ্ট যে কোনো খরচ, ক্ষতি, দায়বদ্ধতা বা ফলাফল থেকে মুক্ত করেন এবং এ বিষয়ে আপনার যে কোনো দাবি বা চাহিদা মওকুফ করেন।
তৃতীয় পক্ষের বিজনেস

অবসান
আমরা, পূর্ব বিজ্ঞপ্তি ছাড়াই, অবিলম্বে এই নিয়ম ও শর্তাবলী বাতিল করতে পারি বা তাদের অধীনে প্রদত্ত আপনার যেকোনো বা সমস্ত অধিকার প্রত্যাহার করতে পারি। সমাপ্তির পরে, আপনাকে অবশ্যই সাইটের সমস্ত অ্যাক্সেস এবং ব্যবহার বন্ধ করতে হবে। আমরা, অন্য কোন আইনি বা ন্যায়সঙ্গত প্রতিকার ছাড়াও, অবিলম্বে আপনাকে জারি করা সমস্ত পাসওয়ার্ড(গুলি) এবং অ্যাকাউন্ট সনাক্তকরণ প্রত্যাহার করব এবং সম্পূর্ণ বা আংশিকভাবে এই সাইটে আপনার অ্যাক্সেস এবং ব্যবহার অস্বীকার করব। সমাপ্তির তারিখের আগে উদ্ভূত পক্ষগুলির সংশ্লিষ্ট অধিকার এবং বাধ্যবাধকতাগুলিকে (প্রদানের বাধ্যবাধকতা সহ) প্রভাবিত করে না। এই ধরনের স্থগিতাদেশ বা সমাপ্তির ফলে সাইটটি আপনার বা অন্য কোনো ব্যক্তির কাছে দায়বদ্ধ থাকবে না। আপনি যদি সাইটটির সাথে অসন্তুষ্ট হন বা সাইটটি পরিচালনার ক্ষেত্রে কোনো শর্ত, শর্ত, নিয়ম, নীতি, নির্দেশিকা বা অনুশীলনের সাথে অসন্তুষ্ট হন তবে আপনার একমাত্র এবং একচেটিয়া প্রতিকার হল সাইটটি ব্যবহার বন্ধ করা।
আইন এবং অধিক্ষেত্রের শাসন
এই শর্তাবলী বাংলাদেশের আইনের অধীনে পরিচালিত এবং ব্যাখ্যা করা হবে। আপনি সম্মত হন যে, ঢাকার আদালত, ট্রাইব্যুনাল এবং/অথবা প্রশাসনিক সংস্থাগুলি এই চুক্তির অধীনে বাংলাদেশের মধ্যে উদ্ভূত কোনো বিরোধের উপর একমাত্র অধিকার রাখবে।

সফটওয়্যার
আমাদের সফটওয়্যারের মধ্যে যেকোনো আপডেট বা উন্নয়ন অন্তর্ভুক্ত যা আমরা আপনার সাইটটি ব্যবহারে সুবিধা করার জন্য প্রদান করি। আপনি সফটওয়্যারটি শুধুমাত্র সাইটে তালিকাভুক্ত শর্তাবলী এবং অন্যান্য প্রাসঙ্গিক প্রযোজ্য শর্তাবলীর অধীনে আমাদের পরিষেবাগুলি ব্যবহার করার উদ্দেশ্যে ব্যবহার করতে পারেন। আপনি সফটওয়্যারের কোনো অংশকে আপনার নিজস্ব প্রোগ্রামের সাথে যুক্ত করতে বা সংমিশ্রণে সঙ্কলিত করতে পারবেন না, অন্য কোনো পরিষেবার সাথে এটি স্থানান্তর করতে পারবেন না, এটি বিক্রি, ভাড়া, লিজ, ঋণ, বিতরণ বা সাব-লাইসেন্স করতে পারবেন না অথবা সফটওয়্যারের কোনো অধিকার পুরো বা অংশে হস্তান্তর করতে পারবেন না। আপনি সফটওয়্যারটি কোনো অবৈধ উদ্দেশ্যে ব্যবহার করতে পারবেন না। আমরা আপনার সেবা প্রদান বন্ধ করতে পারি এবং যে কোনো সময় আপনার সফটওয়্যার ব্যবহারের অধিকার বাতিল করতে পারি। যদি আপনি এখানে বা সাইটে তালিকাভুক্ত যে কোনো শর্তাবলীর সাথে কোনোভাবে মেনে না চলেন তবে আপনার সফটওয়্যার ব্যবহারের অধিকার স্বয়ংক্রিয়ভাবে নোটিশ ছাড়াই বাতিল হয়ে যাবে। সাইটে অন্তর্ভুক্ত বা এভাবে বিতরণকৃত অতিরিক্ত তৃতীয় পক্ষের শর্তাবলী প্রযোজ্য হতে পারে এবং এই শর্তাবলীর সাথে বিরোধের ক্ষেত্রে এই শর্তাবলী দ্বারা সফটওয়্যারের ব্যবহার নিয়ন্ত্রিত হবে। আমাদের যে কোনো সেবা ব্যবহৃত সমস্ত সফটওয়্যার আমাদের এবং/অথবা আমাদের সহযোগী বা এর সফটওয়্যার সরবরাহকারীদের সম্পত্তি এবং বাংলাদেশ সহ প্রযোজ্য কপিরাইট আইনের দ্বারা সুরক্ষিত।
যখন আপনি সাইটটি ব্যবহার করেন, তখন আপনি এক বা একাধিক তৃতীয় পক্ষের পরিষেবা, যেমন একটি ওয়্যারলেস ক্যারিয়ার বা একটি মোবাইল প্ল্যাটফর্ম সরবরাহকারীর পরিষেবাও ব্যবহার করতে পারেন। এই তৃতীয় পক্ষের পরিষেবাগুলির ব্যবহার পৃথক নীতিমালা, ব্যবহারের শর্তাবলী এবং এই তৃতীয় পক্ষের ফি এর অধীন হতে পারে।
আপনি বা অন্য কাউকে সফটওয়্যারের কোনো অংশ বা পুরোটা অনুলিপি করতে, পরিবর্তন করতে, রিভার্স ইঞ্জিনিয়ার, ডিকম্পাইল বা বিচ্ছিন্ন করতে, অথবা আমাদের সফটওয়্যারের সাথে ইচ্ছাকৃতভাবে বা অবৈধভাবে সফটওয়্যারের কোনো কার্যকলাপ করতে উৎসাহিত বা অনুমোদিত করবেন না।
সফটওয়্যারটি আপডেট রাখার জন্য, আমরা যে কোনো সময় স্বয়ংক্রিয় বা ম্যানুয়াল আপডেট দিতে পারি এবং আপনাকে আগাম নোটিশ না দিয়েই এটি করতে পারি।
৩.পণ্য বা পরিষেবার বিক্রির সাথে সম্পর্কিত শর্তাবলী (বিক্রেতা এবং গ্রাহকদের মধ্যে)
এই শর্তাবলী সাবধানতার সাথে পড়ুন কোনো পণ্য অর্ডার দেওয়ার আগে যে বিক্রেতাদের (“আমরা” বা “আমাদের, যেখানে প্রযোজ্য) সাইটে তালিকাভুক্ত। এই শর্তগুলি এই শর্তগুলির দ্বারা আবদ্ধ হওয়ার জন্য আপনার চুক্তিকে নির্দেশ করে৷ এই বিভাগটি সাইটে পণ্য বা পরিষেবার বিক্রির সাথে সম্পর্কিত শর্তাবলীর সাথে সম্পর্কিত।
চুক্তি
যখন আপনি আমাদের সাইটে একটি অর্ডার দেন, তখন আপনি আমাদের সাইটে প্রদর্শিত পণ্য বা পরিষেবাটি কেনার জন্য একটি আইনি প্রস্তাব দিচ্ছেন। আপনার অর্ডার প্রেরণ হওয়ার আগে আপনি যে কোনো নিশ্চিতকরণ বা স্ট্যাটাস আপডেট পাবেন তা শুধুমাত্র আপনার অর্ডারের বিবরণ যাচাই করার জন্য এবং অর্ডার নিশ্চিত করার ইঙ্গিত দেয় না। আপনার অর্ডার নিশ্চিত বলে বিবেচিত হবে যখন পণ্যটি আপনার কাছে পাঠানো হবে। যদি আপনার অর্ডার একাধিক প্যাকেজে প্রেরিত হয়, আপনি পৃথক প্রেরণ নিশ্চিতকরণ পেতে পারেন। আপনি যখন আপনার অর্ডার দেন, তখন আমরা অর্ডার প্রক্রিয়াকরণের জন্য একটি আনুমানিক সময়সীমা প্রদান করি, তবে এই সময়সীমা তৃতীয় পক্ষের পরিষেবা প্রদানকারীদের উপর নির্ভর করে পরিবর্তিত হতে পারে। আমরা এই সময়সীমা মেনে চলার জন্য সমস্ত যৌক্তিক প্রচেষ্টা করব।
সব বাণিজ্যিক/চুক্তিগত শর্তাবলী, যেমন মূল্য, শিপিং খরচ, অর্থপ্রদানের পদ্ধতি, এবং ডেলিভারি বিবরণ, আপনার এবং বিক্রেতার মধ্যে। Cartup এই শর্তাবলী নিয়ন্ত্রণ করে না বা নিজেই জড়িত হয় না। বিক্রেতারা প্রেরণের আগে যে কোনো অর্ডার বাতিল করার অধিকার রাখে। যদি এটি ঘটে, আমরা আপনাকে ইমেল বা এসএমএসের মাধ্যমে অবহিত করব, এবং কোনো অগ্রিম অর্থ প্রদানের ক্ষেত্রে নির্ধারিত সময়ের মধ্যে ফেরত দেওয়া হবে।

মূল্য নির্ধারণ, প্রাপ্যতা এবং অর্ডার প্রক্রিয়াকরণ
সমস্ত মূল্য বাংলাদেশি টাকা (BDT) তে তালিকাভুক্ত এবং বিক্রেতা দ্বারা নির্ধারিত ভ্যাট অন্তর্ভুক্ত। আপনার শপিং কার্টের আইটেমগুলি সর্বদা আইটেমের পণ্য বিবরণী পৃষ্ঠায় প্রদর্শিত সর্বশেষ মূল্য প্রতিফলিত করবে। অনুগ্রহ করে মনে রাখবেন যে এই মূল্যটি আপনি প্রথমে আপনার কার্টে আইটেমটি রাখার সময় দেখানো মূল্যের থেকে আলাদা হতে পারে। আপনার কার্টে একটি আইটেম রাখা সেই সময়ে দেখানো মূল্য সংরক্ষণ করে না। এটি সম্ভব যে আপনার কার্টে আইটেমটি রাখার সময় এবং আপনি এটি কেনার সময়ের মধ্যে একটি আইটেমের মূল্য কমে যাবে।
আমরা আমাদের সাইটে বিক্রি হওয়া কোনো আইটেম বা অন্য ওয়েবসাইটগুলির জন্য মূল্য মিলানোর প্রস্তাব দিই না।
যদিও আমরা আমাদের ব্যবহারকারীদের জন্য সাইটে সবচেয়ে সঠিক মূল্য নির্ধারণের তথ্য প্রদান করার চেষ্টা করি; তবুও, ভুলও হতে পারে; যেমন সাইটে আইটেমের মূল্য সঠিকভাবে প্রদর্শিত না হওয়া। সুতরাং, আমরা যে কোনো অর্ডার বাতিল করার অধিকার সংরক্ষণ করি। যদি কোনো আইটেমের ভুল মূল্য নির্ধারণ করা হয়, তাহলে আমরা, আমাদের নিজস্ব বিবেচনার ভিত্তিতে, আপনাকে নির্দেশনার জন্য যোগাযোগ করতে পারি বা আপনার অর্ডার বাতিল করতে পারি এবং এই ধরনের বাতিল সম্পর্কে আপনাকে অবহিত করতে পারি। আমরা এই ধরনের অর্ডারগুলি বাতিল করার অধিকার সংরক্ষণ করি, তা অর্ডার নিশ্চিত করা হয়েছে কিনা এবং আপনার প্রিপেমেন্ট প্রক্রিয়াকৃত হয়েছে কিনা তা নয়। যদি এই ধরনের একটি বাতিল আপনার প্রিপেইড অর্ডারে ঘটে, তাহলে আমাদের রিফান্ড নীতি প্রযোজ্য হবে। অনুগ্রহ করে মনে রাখবেন যে ফেরত পরিমাণের উপর Cartup এর 100% অধিকার রয়েছে। সাধারণত রিফান্ডের পরিমাণ গ্রাহকের প্রদত্ত মূল্যের ভিত্তিতে গণনা করা হয় যা যেকোনো ধরণের ডিসকাউন্ট এবং শিপিং ফি বাদ দেওয়ার পরে হয়।
সাইটে প্রতিটি পণ্যের প্রাপ্যতা তালিকাভুক্ত করা হয়েছে। প্রেরণের আনুমানিক সময়সীমা নিশ্চিত নয় এবং এর উপর নির্ভর করা উচিত নয়। আপনি যে পণ্যটি অর্ডার করেছেন তা যদি অপ্রাপ্য হয়, তবে আপনাকে ইমেল বা এসএমএসের মাধ্যমে জানিয়ে দেওয়া হবে।
আমরা যে কোনো সময় যে কোনো অর্ডার প্রত্যাখ্যান বা বাতিল করার অধিকার সংরক্ষণ করি। আমরা আপনার অর্ডার গ্রহণ করার আগে অতিরিক্ত যাচাইকরণের জন্য আপনাকে জিজ্ঞাসা করতে পারি।
প্রতারণা প্রতিরোধ করতে, আমরা পণ্য সরবরাহ করার আগে আপনার অর্থপ্রদানের বিবরণ যাচাই করতে পারি এবং আপনার ব্যক্তিগত তথ্য যাচাই করতে পারি। আপনি যদি এই তদন্তগুলিতে সাড়া না দেন তবে আপনার অর্ডার বাতিল হতে পারে। আমরা কোনো আগাম নোটিশ ছাড়াই প্রতারণামূলক কার্যকলাপের সন্দেহ হলে অর্ডার বাতিল করার অধিকার সংরক্ষণ করি।

বাণিজ্যিক উদ্দেশ্যে Cartup পণ্য পুনরায় বিক্রি কঠোরভাবে নিষিদ্ধ। অননুমোদিত পুনঃবিক্রেতারা আইনি পরিণতির সম্মুখীন হতে পারেন।

আপনি সাইট থেকে পণ্য ক্রয়ের সাথে সম্পর্কিত সমস্ত ফি/খরচ/চার্জ প্রদানের জন্য দায়ী থাকবেন এবং সমস্ত প্রযোজ্য ট্যাক্স বহন করতে সম্মত হন।
প্রতিনিধিত্ব এবং ওয়ারেন্টি
আমরা আমাদের সাইটে তৃতীয় পক্ষ দ্বারা বিক্রি করা পণ্যগুলির গুণমান, মূল্য বা বিক্রয়যোগ্যতা সম্পর্কে কোনো প্রতিনিধিত্ব বা ওয়ারেন্টি করি না। তৃতীয় পক্ষের দ্বারা কোনো ভুল বা ত্রুটির জন্য আমরা দায়বদ্ধ নই। আপনার এবং বিক্রেতার মধ্যে চুক্তি লঙ্ঘন বা অকার্যকর হওয়ার জন্য আমরা দায়ী নই।
মূল্য নির্ধারণ এবং সম্পর্কিত তথ্য প্রযুক্তিগত সমস্যার কারণে বা ভুল হতে পারে। আমরা এই ধরনের ভুল মূল্য নির্ধারণের উপর ভিত্তি করে কোনো অর্ডার বাতিল করার অধিকার সংরক্ষণ করি আগাম নোটিশ বা দায় ছাড়াই। এই ধরনের অর্ডারের জন্য প্রিপেমেন্ট আমাদের রিফান্ড নীতির অধীনে ফেরত দেওয়া হবে।
